The Superintendence of Industry and Commerce (SIC) of Colombia, as National Authority for Competition Protection, opened an investigation against one company (AVINCO) and three individuals for alleged infractions to the competition protection regime, due to evidence of misconduct in contractual selection processes carried out by the Colombian National Institute of Highways (INVIAS) and the National Tourism Fund (FONTUR).
AVINCO presented itself as an independent bidder in the contracting processes carried out by the aforementioned authorities, even though there is evidence that there were joint decisions with competing companies, such as DVG. This articulation included defining in which processes each company would present itself, managing the requirements to present the proposals, as well as defining the value of the proposals and, finally, jointly executing the contracts that were awarded to them.
